TRANSFERS

“PWM” does not transfer Personal Data, except in the cases provided for in Article 37 of the Mexican Federal Law for the Protection of Personal Data in Possession of Individuals.

In particular, the following items:

1. When the transfer is foreseen in a Law or Treaty to which Mexico is a party;

2. When the transfer is made to controlling companies, subsidiaries or affiliates under the common control of the responsible party, or to a parent company or to any company of the same group of the responsible party that operates under the same internal processes and policies;

4. When the transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the data owner, by the data controller and a third party; and

7. When the transfer is necessary for the maintenance or fulfillment of a legal relationship between the data controller and the data subject.

RIGHTS EXERCISE

In the terms allowed by the applicable regulations, you may access, rectify and cancel your personal data, oppose to its processing, as well as revoke at any time the consent you may have given us, by e-mail:

Your request must contain

• Complete name

• Simple copy or digital copy of the oficial identification (ID Card, passport, etc.).

• Representation: In case of acting on behalf of a minor, you must submit birth certificate or oficial document where the parent or guardian’s personality is accredited; in case of acting on behalf of a third party of legal age, you must attach the power of attorney where your powers to act on behalf of the former are demonstrated.

• Brief description of what you are requesting, either access to your data, rectification or cancellation thereof, opposition to treatment or some purposes of treatment or withdrawal of consent.

• To rectify your name or address, attach a copy of proof in case it is different from the oficial identification presented to prove identity.

The response period will be twenty business days based on the official calendar published in the Mexican Official Gazette of the Federation.

The response to your request will be sent through the same means by which it was received, that is, via email.

If you do not receive a response from us or if it is unsatisfactory, you have a period of 15 business days to go to the Mexican Authority for the Protection of Personal Data (Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales a.k.a. INAI) and request the initiation of a procedure for the protection of your rights.

MECHANISMS FOR LIMITING THE USE AND DISCLOSURE OF DATA AND WITHDRAWING CONSENT

You may limit the use, disclosure of your personal data, revoke your consent or object to the processing of your personal data for secondary purposes via e-mail.
